Code Compliance and Deed Restrictions

The following are common code violations cited by the City of Dallas. For the list of top violations, visit here. Report violations to Dallas 311.

MOTOR VEHICLES
Junk Motor Vehicles (Sec. 18-20) — an inoperable vehicle is a public nuisance on any property.up to $200
Oversized Vehicles (Sec. 28-81) — no truck-tractor, road tractor, semi-trailer, bus, or trailer over one ton on residential property/right-of-way.$20
24 Hour Parking (Sec. 28-84) — no unattended vehicle parked on a public street/alley for over 24 hours.$15
Parking on Unapproved Surface (Sec. 51A-5.401(d)(5)) — no vehicle parked on lawn or unapproved surface.$45
YARD MAINTENANCE
NOTE: Owner is responsible for their property from the front curb to the middle of the alley.
Weeds/Grass/Vegetation (Sec. 18-13, 18-14) — cannot exceed 12 inches; duty to prevent nuisance or fire hazard.$50–$2,000
Dead Trees (Sec. 27-11(a)(5)) — owner shall remove dead trees/limbs reasonably capable of causing injury.$500–$2,000
LITTER / OUTSIDE STORAGE
Litter/Trash (Sec. 7A-18) — responsible for litter/trash on property, gutter, and half of the alley.$100–$2,000
Bulky Trash (Sec. 18-4(e)) — must be placed behind curb line no earlier than the Thursday before, or later than 7 AM Monday of collection week.$50–$2,000
Outside Storage (Sec. 51A-4.217) — 5% Rule: only 5% of a lot may be used for outside storage.$200–$2,000
Illegal Outside Storage (Sec. 51a Section 4.213(b)(9)) — an item outside over 24 hours that isn't resistant to weather/deterioration (unless zoning/CO permits).varies
BUILDING EXTERIOR
Paint (Sec. 27-1(b)(l)) — owner shall protect exterior surfaces by applying paint or other coating.$200–$2,000
Windows (Sec. 27-11(b)(5)) — owner shall maintain a structure in weather-tight and watertight condition.$500–$2,000
Open/Vacant (Sec. 27.11(a)(6)) — owner shall keep doors and windows of a vacant structure securely closed.$500–$2,000
Graffiti (Sec. 31-38) — property owner is responsible for removing graffiti from sidewalks, walls, fences, signs, and other visible structures.$200–$500
Fence (Sec. 27-11(b)(10)) — owner shall maintain any fence on their property so it's not out of alignment more than 12 in. for a fence over 4 ft (6 in. for 4 ft or less); repair/replace rotted, damaged, or broken slats/posts/hardware and loose materials on masonry walls.$200–$2,000
ALCOHOLIC BEVERAGES
Open Container (Sec. 6-6.l(b)) — offense to possess an open container or consume alcohol on a public street/alley/sidewalk within 1,000 ft of a pre-K–12 school.up to $500
Consuming Alcohol (Sec. 6-6.1(a)) — offense to consume alcohol on property owned/leased by the city, or within 18 ft of a public street.up to $500
Alcohol in Public Parks (Sec. 32-1 1.3(a)) — offense to consume/possess alcohol in a public park on a street, sidewalk, or parking area adjacent to a park.up to $500
City Park Hours (Sec. 32-9.l(c)) — offense to be on public park premises between midnight and 5am.up to $500
MISCELLANEOUS ORDINANCES
Discharging a Firearm in a Private Place (Sec. 31-4(a)) — offense to discharge a firearm/weapon in a place not customarily open to the public.up to $500
Urinating or Defecating in Public (Sec. 32-18(a)) — offense in/on any public property (street, alley, sidewalk, yard, park, building, structure, plaza) or public view.up to $500
Loud and Disturbing Noises (Sec. 30-1) — offense to make/cause noise unreasonably offensive to ordinary sensibilities (e.g. loud music, car horn).up to $2,000
Storm Drain Discharges (Sec. 19-118.2(a)) — offense to discharge water into storm drains other than stormwater (exceptions: lawn watering, individual residential car washing).up to $2,000
Working from Home (Sec. 51A-4.217(b)(8)) — must be incidental to residential use; no ad/sign visible off-premises, no more than 2 non-resident workers, limited hours/visitors, no on-premises sale/offer/advertisement of products.$200–$2,000
Garage Sales (Sec. 51A-4.217(b)(9)) — no more than 2 garage sales in any 12-month period on the same property; must be held in a building/garage or on the patio only.$200–$2,000
Signs (Sec. 7A-16) — no posting notices/signs on a lamppost, pole, or tree on public right-of-way, structure, or building.$50–$2,000

Deed Restrictions

Prestonwood follows both the City of Dallas code of ordinances and the Prestonwood deed restrictions. The developer filed a Declaration of Covenants, Conditions and Restrictions in the Dallas County Deed Records for each addition, encompassed by the Prestonwood Homeowners Association.

Most sections within the area have identical or near-identical deed covenants and restrictions. Each homeowner should obtain a copy of the recorded restrictions that apply to their property.
